OSHA Releases Union Walkround Rule

On Friday, March 29, OSHA released its final Walkaround rule, which opens the possibility for a union representative to join a Compliance Safety and Health Officer on an inspection of a nonunion job site. IEC opposed the proposed rule in its comment letter and will continue to push back on the final rule, which takes effect on May 31.

House Passes Legislation Reauthorizing WIOA

Yesterday, the U.S. House of Representatives passed H.R. 6655, A Stronger Workforce for America Act, which reauthorizes and updates the Workforce Innovations and Opportunity Act (WIOA). The legislation, for which IEC voiced its support, must now receive consideration by the U.S. Senate. The proposal includes a number of improvements to the WIOA system, among those are:

  • A mandate that 50 percent of the funds allocated to any local workforce area be spent
  • specifically on skills development rather than administration costs.
  • Consolidated innovation grants that will allow some states and local workforce boards to pursue innovative reforms.
  • The establishment of a Critical Industry Skills fund, which will encourage and incentivize employer engagement by creating a new fund to reimburse employers.
  • The creation of performance metrics which includes holding local areas accountable for the percentage of workforce system participants enrolled in certain programs, including on-the-job training and apprenticeship.

IEC Working to Revoke Independent Contractor Rule

IEC is working with its industry allies in support of H.J.Res.116, a resolution that, if passed and signed by the president, would completely invalidate the Independent Contractor recently finalized by the Department of Labor. The rule, which took effect March 11, is currently being challenged in court. IEC opposed the ambiguous and complicated new rule, which replaces the one promulgated under the Trump administration, which IEC supported.
