Senate Clean Energy Deal Includes IEC-Opposed Labor Provisions

Senator Joe Manchin (D-WV) has agreed to support a $369 billion tax, energy, healthcare and climate plan; the latest Democrat attempt to enact legislation through the reconciliation process, which bypasses the 60-vote filibuster vote and needs only a simple majority to pass. The proposal, known as the Inflation Reduction Act of 2022, is a step down from the initial $3.5 trillion Build Back Better plan, which IEC worked to defeat last year. Included in the new bill are provisions that would increase the tax benefit of certain clean energy projects in which the contractor pays prevailing wage and uses registered apprentices. IEC will oppose such labor provisions being inserted in the tax code. Under the reconciliation process, the bill must be reviewed by the Senate Parliamentarian, who will decide if parts of the bill violate the reconciliation rules by not directly impacting the budget. It’s also not clear if the bill has the support of the other Senate Democrats, especially Kyrsten Sinema (D-AZ), who also opposed last year’s bill.
