Tell the Biden Administration to Withdraw its PLA Mandate Proposal
IEC is calling on its members to ask the Biden administration to withdraw a proposed rule that would require project labor agreements (PLAs) on federal construction contracts of $35 million or more.
The proposed rule, issued by the Federal Acquisition Regulatory (FAR) Council on August 19, implements President Biden’s February 4Executive Order 14063 mandating PLAs on federal construction contracts procured by federal agencies.
Government-mandated PLAs are anti-competitive schemes that restrict competition, increase costs, create delays, and place nonunion contractors at a significant competitive disadvantage. Studies show that PLA mandates increase construction costs by 12% to 20% and exacerbate the construction industry’s skilled labor shortage by excluding 87% of the U.S. construction industry from building large-scale federal construction contracts.

Biden Administration Announces Revision to Independent Contractor Rule
The Biden administration has announced that Thursday it will publish in the Federal Register its proposed independent contractor rule that is designed to replace the Trump-era standard IEC endorsed. The proposed changes would return to a “totality-of-the-circumstances” analysis using a multi-factor economic realities test that considers factors of the working relationship to determine whether the worker is truly in business for themselves. Labor unions have pushed for this revised rule under the guise of worker misclassification. IEC will issue comments on the proposed rule, which are due on November 28.
GSA Final Rule Permits Union Organizing on Federal Property
On September 2, the General Services Administration (GSA) issued a final rule to allow unions access to federal property for the purpose of soliciting membership from the employees of federal contractors. Previously, these activities were barred by a general prohibition on soliciting, posting, and distributing materials in or on federal property controlled by the GSA.The final rule is effective immediately, but comments can still be submitted by November 2 through Regulations.gov.
