Proposed Joint Employer Rule Comment Period Extended

Late last month, the National Labor Relations Board’s (NLRB) issued a 30 day extension for comments on its proposed joint employer rule. Comments, which were originally due on November 13, 2018, are now due on December 13, 2018.

The proposed rule would clarify the NLRB’s test for determining whether separate businesses qualify as joint employers. The rule proposes that the NLRB will only find that a business jointly employs another’s workers if it “possesses and exercises substantial, direct and immediate control” over them.
