NLRB Extends Deadline for Proposed Joint Employer Rule Comments

The National Labor Relations Board recently extended the deadline for comments on the proposed revision to the Obama-era joint employer rule by an additional month. The rule put in place in 2015 is overly broad and could lead to the finding of joint employment in almost every contractor business arrangement. The NLRB’s proposed rule would only find that a business jointly employs another’s workers if it “possesses and exercises substantial, direct and immediate control” over them. IEC is urging its members to send comments to the NLRB in support of the proposed rule, which are now due by Monday, January 14, 2019.
