Labor Riders Included in House Appropriations Bill

On July 7, 2016, the House Labor, Health, and Human Services; Education; and Related Agencies Subcommittee on Appropriations approved its funding bill for FY2017. Included in the legislation was language that would prohibit funding over the next fiscal year for the implementation of the ambush elections rule; new joint employer standard; the NLRB-ruling, allowing for smaller bargaining units or “micro-unions;” the new overtime threshold; and electronic voting. The Senate’s version of the bill was voted out of committee last month; however, it lacked similar policy rider language.

The odds of both chambers bringing each bill to the floor for a successful vote is slim; however, should each pass as written, the differences between the two would need to be worked out in a conference committee. The most likely scenario is to attempt to attach these policy riders to a year-end omnibus. The House bill now goes to the full committee next week for consideration. IEC will continue to work to advance legislation to amend, if not completely repeal, each of these policies.
