Labor Department Files Appeal of Overtime Rule

The Department of Labor (DOL) filed an appeal to a Texas judge’s decision to toss out the Obama-era rule that more than doubled the Fair Labor Standards Act's salary threshold for overtime from $23,660 to $47,476 and included automatic increases every three years. The DOL is seeking to defend its authority to define and delimit the overtime regulations, but is backing away from the substantially higher salary limit. The DOL is asking the court to hold the appeal in abeyance while it rewrites the current overtime regulations.

IEC has actively opposed the higher overtime limit and recently submitted comments to the DOL’s request for information for a new rule.
