IEC Joins Amicus in Case Addressing “Ambush” Election Rule

IEC joined a coalition of employer organizations in an amicus brief in known as UPS Ground Frieght v NLRB. The case is the first challenge in federal court to the Obama-era ambush election rule. The brief asks the U.S. District Court of Appeals DC Circuit to grant UPS’ Petition for Review to address the rule’s blatant disregard for employers’ due process rights as well as the Board’s inability or unwillingness to remedy the problems created by the rule. IEC continues to fight in the courts, Congress and before regulatory agencies for fairness in the union election process.
