Election Rule Comment Period Gets Extension

The National Labor Relations Board (NLRB) request for information (RFI) regarding the current representation election regulations, or ‘ambush’ election rule, has received an extension. The current rules, which were finalized in December of 2014 and took effect in April of 2015, expedited the union election process, eliminating many employer due process rights. In review of the rule, the Board is asking three questions:
1. Should the 2014 Election Rule be retained without change?
2. Should the 2014 Election Rule be retained with modifications? If so, what should be modified?
3. Should the 2014 Election Rule be rescinded? If so, should the Board revert to the Election Regulations that were in effect prior to the 2014 Election Rule’s adoption, or should the Board make changes to the prior Election Regulations? If the Board should make changes to the prior Election Regulations, what should be changed?
The comment deadlines was extended from February 12, 2018 to March 19, 2018. IEC has been a staunch opponent to these rules and will be urging that they be rescinded altogether.
