Efforts to Thwart ‘Ambush’ Election Rule Continue

Efforts to stop the ‘ambush’ election rule continue in both the courts and Congress. Put in place last April by the National Labor Relations Board (NLRB), the rule provides for the possibility of a union election to take place in just under two weeks. Last Thursday, the Fifth Circuit Court of Appeals heard arguments on behalf of the Associated Builders and Contractors of Texas and the National Federation of Independent Businesses stating that the NLRB overstepped its legal authority. Meanwhile, Congress continues to consider ways to amend the rule through legislation as well as limiting its implementation through the appropriations process.
