DOL Publishes Request for Information on Overtime Rule
In late July, the Department of Labor’s (DOL) Wage and Hour Division (WHD) submitted a Request for Information (RFI) from employers on how it should handle overtime for non-exempt employees. As you may recall, the Obama administration proposed to more than double the Fair Labor Standards Act's salary threshold for overtime from $23,660 to $47,476, and it included automatic increases every three years. A court issued a temporary injunction halting its implementation in November. In June, the Trump administration chose to drop its defense of the proposal.
The RFI means the DOL will likely propose a new rule and is asking employers a number of questions on how the government should handle overtime pay regulations. IEC will continue to work with the Partnership to Protector Workplace Opportunity on this issue and will submit comments to the DOL, which are due on Monday, September 25.
