Fifth Circuit Court Denies Enforcement of NLRB's Order Concerning IEC-TGC's Shared Man Program

On Monday, the United States Court of Appeals for the Fifth Circuit, in a 2-1 decision, refused to enforce an Order of the National Labor Relations Board (NLRB) that would have forced Independent Electrical Contractors – Texas Gulf Coast Chapter (formerly Independent Electrical Contractors of Houston, Inc.) (IEC) to maintain written records of the operation of its application service for a two-year period.

Honeymoon Not Over for Villwock

Spenser Villwock said he’s in Colorado on a “permanent honeymoon.”

When he and his wife moved to Colorado to celebrate their honeymoon in 2007, they planned to stay for only a few months.

“But we fell in love with Colorado, started our family here, and we’ll live here for the rest of our lives,” Villwock said.

Villwock is the CEO of Denver-based Independent Electrical Contractors–Rocky Mountain (IECRM), a nonprofit electrical trade association that oversees about 200 member businesses and contractors in the energy and electrical industries across northern Colorado and Wyoming.

Fall 2013 Legislative and Regulatory Outlook

Depending on the outcome of the current government shutdown precipitated by Congress’ failure to agree to a funding resolution to keep federal agencies running, previously projected legislative and regulatory actions could potentially be delayed or derailed by an ongoing fiscal crisis. Government Shutdown: What IEC Members Should Know

Late into the evening on Monday, the United States Congress failed to reach an agreement on legislation to fund federal agencies by the September 30 appropriations deadline before the start of Fiscal Year 2014, leading to a government shutdown effective at midnight on October 1. In contention was House Republican language tacked on to a short-term spending resolution that would defund President Obama’s health care bill, which the Democrat-controlled Senate stripped in its consideration of the measure. Republicans countered with a one-year delay of only the “individual mandate” of Obamacare which was again defeated by the Senate, assuring government closures and furloughs Tuesday morning.
