DOL Issues Notice to Rescind Persuader Rule

On June 12, 2017, the Department of Labor (DOL) issued a new notice of proposed rulemaking (NPRM) to rescind the Obama administration’s persuader rule. You can join IEC and issue your own comments supporting removal of this rule by clicking here.

The Obama administration had proposed an expansion of the persuader rule that would subject all outside labor law attorneys and consultants, as well as the businesses that hire them, to certain reporting requirements. For decades, these reporting requirements have only applied to situations where businesses hired third party consultants that had direct contact with employees on labor matters. Late in 2016, a federal judge in Texas issued a permanent injunction against the rule, preventing it from taking effect. The Trump administration is expected to drop its defense of the rule.
